Williston, ND (KEYZ)  Following very brief closing arguments by both sides in the case, the continuous rape trial of 42 year old Juan Martinez is now in the hands of the jury. Martinez is accused of raping the girl at least nine times back 2017 when she was only 12. The charges came to light when the victim confided in a teacher at Williston Middle school about the allegations. Both sides gave the jury a lot to think about; the victim gave emotionally charged testimony yesterday about the nine times she endured sexual assault allegedly by Martinez, while the defendants attorney's said there was not a lick of physical evidence linking him to the crime and in fact the DNA evidence found in the girls bed, belonged to another man, a white man.

 

Williston, ND (KEYZ)  The victim in the Juan Martinez continuous rape trial in Williston, took to the stand Wednesday testifying that the 42 year old raped her at least nine times in 2017, despite defense attorney arguments that there exists no physical evidence linking him to the attacks.

The girl, who was 12 at the time denied vigorously that her allegations were made up, and told the court she had told her teacher about it, because she "related to her", and felt that that teacher, "knew what she was going through".

A blow for the prosecution came as an expert witness from the state's crime lab, testified that all four male DNA samples taken from a bed the girl slept on, were not form Martinez, in fact all four were from the same white male.  The defense presents it's case today.
